These terms of use are an agreement between you and JobSearch123 ("JobSearch123", "we", "us"), the operator of jobsearch123.com (the "Site"). JobSearch123 is a trading name of Canterbury Plasterers Ltd. By visiting the Site, creating an account, posting a listing or sending a message you agree to these terms. If you do not agree, please do not use the Site.

1. What JobSearch123 is, and what it is not

  • JobSearch123 is an online job board for the United States. Employers and staffing agencies post jobs, and job seekers search, save and apply.
  • JobSearch123 is not an employer, employment agency or staffing firm. We do not screen, interview, hire, pay or place workers, we are not a party to any employment relationship, and we do not guarantee that a job is genuine, still open or suitable.
  • Posting and browsing are free. If we ever introduce paid features, the price will be shown before you pay and these terms will be updated first.

2. Who may use the Site

  • You must be at least 18 years old to create an account, except that job seekers aged 16 or 17 may create an account on JobSearch123 to look for work they are legally allowed to do. The Site is not meant for children under 13 and we do not knowingly collect their information.
  • You must give accurate details and keep them up to date. Businesses must register with their real business name.
  • We may refuse, suspend or close an account where we believe these terms have been broken, where we see fraud or abuse, or where the law requires it.

3. One account for all our sites

  • quote99.com, houses99.com and jobsearch123.com are run by the same operator and share one membership. An account created on any of them is the same account on all of them, with the same profile, listings, messages and settings. A warning, suspension or closure on one of them applies on all of them.
  • Keep your password private and use a password you do not use anywhere else. You are responsible for what happens on your account. Tell us at once through a support ticket if you think someone else has used it.

4. Listings and content

  • You may only post what you have the right to post. Listings must be honest, legal, in the right category and about something that is really available.
  • Not allowed: anything illegal or unsafe, weapons, drugs, counterfeit goods, adult content, spam, duplicate listings, misleading prices, links to off site payment, and content that is hateful, harassing or threatening.
  • You keep the rights to what you post. You give us a worldwide, non exclusive, royalty free license to host, show, copy, resize and share it on the Site and to promote the Site, for as long as it stays on the Site.
  • We may edit the category of, hide or remove any listing or content that breaks these terms or the law.

5. Rules for jobs and applications

  • Real jobs only. Every job must be a genuine, open position with a real employer. Pyramid schemes, jobs that require an upfront payment, commission only roles described as salaried and work from home schemes that charge applicants are not allowed.
  • No fees to job seekers. Employers and staffing agencies may never charge a job seeker to apply, to be interviewed or to be considered, or ask for bank details, a Social Security number or payment before a written job offer.
  • Equal opportunity. Jobs must follow federal law (Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Equal Pay Act and others) and state and local law. A job may not express a preference based on race, color, religion, sex, pregnancy, sexual orientation, gender identity, national origin, age, disability, genetic information or veteran status.
  • Pay. Every job shows the pay or pay range. Several states and cities require a good faith pay range in every job posting, and the employer is responsible for following those laws.
  • Staffing agencies must say that the job is posted by an agency and must have the employer's permission to advertise it.
  • Applications. When you apply, your application and resume are sent to that employer, who becomes responsible for them under its own privacy policy and the law.

6. Messages, meetings and payments

  • Use the Site's messages to talk to other members. Do not send spam, unsolicited marketing or messages that break the TCPA or CAN-SPAM rules.
  • Meet in safe places, check documents, and never send money by wire transfer, gift card, cryptocurrency or a payment app to someone you have not met. JobSearch123 never asks for payment by message.
  • Any deal is between the members involved. We are not responsible for the quality, safety or legality of what is offered, or for whether a member pays or performs.

7. Copyright complaints (DMCA)

If you believe content on the Site infringes your copyright, open a support ticket with: your contact details, the work you own, the address of the content, a statement that you have a good faith belief the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature. We remove infringing content and may close the accounts of repeat infringers. A member whose content was removed may send a counter notice in the same way.

8. Disclaimers

The Site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non infringement. We do not promise that the Site will always be available or free of errors, or that any listing, member or statement is accurate.

9. Limitation of liability

To the fullest extent the law allows, JobSearch123 and Canterbury Plasterers Ltd are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site or any dealing with another member. Our total liability for any claim is limited to the greater of one hundred US dollars or the amount you paid us in the twelve months before the claim. Some states do not allow these limits, so they may not apply to you.

10. Indemnity

You agree to defend and hold harmless JobSearch123 and Canterbury Plasterers Ltd from claims, losses and costs (including reasonable attorney fees) that come from your content, your listings, your dealings with other members or your breach of these terms or the law.

11. Ending your use

You can close your account at any time from your account page (how to delete your data). We may suspend or close accounts as set out above. Sections 4, 8, 9, 10 and 12 continue after an account is closed.

12. Changes, governing law and disputes

  • We may change these terms. If a change is important we will tell members on the Site before it takes effect. Using the Site after that means you accept the new terms.
  • These terms are governed by the laws of the State of Delaware and applicable federal law, without regard to conflict of law rules. You may bring a claim in small claims court where you live. Otherwise, claims are brought in the state or federal courts located in Delaware. Nothing in these terms takes away rights you have under the consumer protection laws of your state.
